Introduction

This Privacy Policy applies to our use of the platform offered by Brain.One, Inc. (“Brain.One”, “We” or “Us”). By using or accessing our platform or other services (“Services”) in any manner, you acknowledge that you accept the terms and conditions found in this Privacy Policy, and you hereby consent that we will collect, use, and share your information.

This policy describes the types of information we may collect from you or that you may provide when you use the Services and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy applies to all users of our Services. It does not apply to information collected by (i) us offline or through any other means, including on any other website operated by Brain.One or any third party (including our affiliates); or (ii) any third party (including our affiliates), including through any application or content (including advertising) that may link to or be accessible from or on the Services. If you disagree with our policies and practices, your choice is not to use our Services. By accessing or using this Service, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of these Services after we make changes is deemed to be acceptance of those changes, so please check the privacy policy periodically for updates.

Remember that your use of Services is at all times subject to our USER TERMS OF SERVICE, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the User Terms of Service.

1. Personal Information and How We Collect It.

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you access or use our Services. We receive and store just about all information you directly provide to us while using Services, including various types of Personal Information. We do not knowingly collect or solicit personal information from anyone under the age of 18. If you are under 18, please do not attempt to use the Services or send us any personal information about yourself. If we learn that we have collected personal information from a child under the age of 18, we will delete that information as quickly as possible. 2. Disclosure of your Information

We may choose to buy or sell assets and may share and/or transfer account, contact, and other Personal Information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired or go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party. We may de-identify your Personal Information so that you are not identified as an individual and provide that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services so that they can provide you with an optimal online experience. In some circumstances, we employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services; for example, we may use a third-party mail management service to send you emails. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order; enforce or apply this Privacy Policy and other agreements; or protect the rights, property, or safety of EHS, our employees, our users, or others.

3. Data Security.

We endeavor to protect the privacy of your Personal Information we hold in our records. While we take strict measures to safeguard information, we cannot guarantee complete security, such as from unauthorized entry or use, hardware or software failure, and other factors that may compromise the security of user information.

4. State Law Privacy Rights‍‍.

California Resident Rights‍ Under California Civil Code Sections 1798.83-1798.84: California residents are entitled to contact us to prevent disclosure of Personal Information to third parties for such third parties direct marketing purposes; in order to submit such a request, please contact us at hello@brain.one. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites, web applications, and services that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support DO Not Track requests at this time. To find out more about “Do Not Track,” you can visit hello@brain.one. Nevada Resident Rights:‍ If you are a resident of Nevada, you have the right to opt out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. You can exercise this right by contacting us at hello@brain.one, with the subject line “Nevada Do Not Sell Request,” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Information as sales are defined in Nevada Revised Statutes Chapter 603A.

5. Opting Out.

You can always opt not to disclose information to us and add, update, or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. Some information may remain in our records even if you request deletion of such information from your account. We may use aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
